1. PURPOSE AND SCOPE
This Privacy Policy outlines our practices regarding the collection, use, and disclosure of your information when you access or use JetPlus ELD services within the United States. It also explains your privacy rights and the legal protections afforded to you under U.S. federal and state laws.
JetPlus ELD operates in two capacities:
- As a Business/Controller: When we determine the purpose of processing for website visitors and account administrators.
- As a Service Provider/Processor: When we process driving logs, GPS data, and vehicle diagnostics on behalf of a motor carrier (our Customer) to meet FMCSA requirements.
2. INFORMATION WE COLLECT
To provide our full range of Services and ensure compliance with the Department of Transportation (DOT) mandates, we collect the following:
- Personal and Company Information: Name, email, phone number, Commercial Driving License (CDL) number, photos/images, address, company name, DOT number, and MC number.
- Vehicle and Driving Data: Engine data (VIN, odometer, engine hours) collected via the vehicle’s ECM, and electronic records of duty status (RODS).
- Precise Geolocation: Real-time GPS location data automatically collected to fulfill federal mandate requirements for ELDs (49 CFR Part 395).
- Usage Data: Device IP address, browser type, unique device identifiers, and diagnostic data collected during mobile or web interaction.
- Cookies: Small files stored on your device to identify you and improve the quality of our system.
JetPlus collects approximate location data during the use of its app. This data will be used for providing location-based features like fleet tracking and routing. This is personal and sensitive information and is kept private to JetPlus only.
The locational data may be used for:
- Proximity Search: Enables the exploration of vehicle/asset locations relative to a point in a time window.
- Privacy Button / Location Privacy Modes: Offers in-vehicle solutions to temporarily turn off GPS location tracking for privacy reasons.
- Geofenced Recording Controls: Implements privacy mode rules based on entry/exit of designated geographic areas.
Background Location Usage
JetPlus ELD collects precise location data, including in the background (even when the app is closed or not in use), to provide Electronic Logging Device (ELD) functionality and ensure regulatory compliance. Background location is required to automatically record driving activity, detect trip start and stop events, maintain accurate duty status logs, and generate compliant reports without interruption during trips.
Location data is used solely for ELD compliance, trip tracking, fleet management, and safety purposes. We do not sell location data to third parties.
Users may disable location permissions in device settings; however, doing so may limit or disable ELD features and may result in incomplete or non-compliant driving logs.
3. USE OF YOUR PERSONAL DATA
JetPlus ELD utilizes collected data for the following essential purposes:
- Service Maintenance: Monitoring usage and ensuring the integrity of Hours of Service (HOS) logs.
- Account Management: Providing access to specialized features based on your registration details.
- Contract Performance: Executing purchase agreements and ensuring compliance with our Terms of Service.
- FMCSA Compliance: Automatically generating and formatting data files for telematic transfer to law enforcement during roadside inspections.
- Communication: Contacting you via email, SMS, or push notifications regarding security updates, alerts, or relevant service information.
4. U.S. STATE PRIVACY RIGHTS (CCPA/CPRA)
If you are a resident of California (or other states with similar privacy laws), you have specific rights regarding your personal data:
- Right to Know: You have the right to request a disclosure of the categories and specific pieces of personal data we have collected.
- Right to Delete: You may request the deletion of your personal data, subject to certain exceptions (such as the legal requirement to maintain HOS logs).
- Right to Limit Sensitive Information: You have the right to limit our use of sensitive personal information (like precise GPS) to only what is necessary to perform ELD services.
- Do Not Sell or Share: JetPlus ELD does not sell your personal data to third parties. We only share data with service providers for business purposes.
5. INFORMATION SHARING
JetPlus ELD shares personal information only in the following limited circumstances:
- With Consent: Sharing sensitive information requires your explicit "opt-in" consent.
- Service Providers: We share data with trusted third-party vendors who assist in hosting our secure servers and processing data. These parties are contractually bound to maintain confidentiality and data security.
- Legal Necessity: We will disclose information to satisfy any applicable law, regulation (such as FMCSA audits), or enforceable governmental request.
- Business Transfers: In the event of a merger, acquisition, or sale of assets, your information may be transferred, subject to notification.
6. DATA SECURITY AND RETENTION
- Security: We apply reasonable technical, administrative, and physical safeguards. JetPlus ELD complies with the Payment Card Industry Data Security Standard (PCI-DSS) for payment processing.
- Federal Retention Requirements: In accordance with 49 CFR § 395.22, we retain ELD records (HOS logs) for a minimum of 6 months.
- User Responsibility: You are responsible for keeping your password secure and changing it at least every 90 days.
7. CHILDREN’S PRIVACY
Our services are not directed to children under the age of 16. We do not knowingly collect personal data from minors. If such data is discovered, it will be deleted within a reasonable timeframe.
8. CHANGES TO THIS POLICY
We may modify this Privacy Policy from time to time to reflect service improvements or legal changes. Material changes will be notified via our website or direct email. Continued use of the Service after changes are posted constitutes acceptance of the new terms.
